This writ petition is filed under Article 226 of the Constitution of India, for the following relief:

"To issue an appropriate writ, issue or Writs, Order or Direction more in the nature of a Writ of Mandamus declaring the in action on the part of the Respondent in not finalizing the amounts admittedly due and payable to the Petitioner in respect of the work "Formation of Reservoir across Veeraswamy Gudi Vagu, Sirigiripadu village, Veldurthi Mandal, Guntur District" as illegal and arbitrary and consequently direct the Respondents to release the amounts to the Petitioner in the interest of justice." 2.

The grievance of the petitioner herein precisely in the present writ petition is the inaction on the part of the respondents in finalising the amounts due under the works contract.

It is submitted by the learned counsel for the petitioner that for redressal of grievance the petitioner herein submitted representation on 18.05.2016 to the Chief Engineer, Minor Irrigation CAD Department/second respondent herein and no action has been taken on the said representation so far. On the other hand, it is submitted by the learned Government Pleader that appropriate action will be taken on the said representation in accordance with law.

Recording the said submission of the learned Government Pleader, without expressing any opinion on the merits of the matter, the writ petition is disposed of, directing the Chief Engineer, Minor Irrigation CAD Department/second respondent herein to take appropriate action on the representation dated 18.05.2016 said to have been submitted by the petitioner herein, strictly in accordance with law, within a period of three months from the date of receipt of this order. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date:13.02.2017 grk
