HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38700 of 2016 ORDER:

The present writ petition is filed by the petitioners seeking to call for the records relating to CC No.405 of 2015, on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad, and quash the same.

Heard and perused the record.

After perusing the record, this Court is of the view that this writ petition is not maintainable and therefore, the same is liable to be dismissed.

At this stage, learned counsel for the petitioners submitted that petitioners may be permitted to file a discharge application before the Court below and till disposal of the said discharge application, their presence may be dispensed with before the Court below. Considering the submissions of the learned counsel for the petitioners, the petitioners are permitted to file a discharge application before the Court below, and on such application being filed, the Court below shall consider the same in accordance with law, and till the disposal of the said discharge application, the presence of the petitioners is dispensed with before the Court below. Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
