The petitioner obtained loan from the Trinity Cooperative Urban Bank Limited. For recovery of the outstanding amount, arbitration proceedings were initiated and ultimately an award was passed on 30.08.2012. Against the said award, there is a remedy of appeal and it is not clear from the averments in the writ affidavit whether the petitioner availed the said remedy.

However, the fourth respondent filed

E.P.No.02/TNCUB/2013, and when the notice, dated 15.04.2015, under Rule 52(6) of the Andhra Pradesh Co-operative Societies Rules was issued, the present Writ Petition is filed.

Learned Counsel for the petitioner disputes the taking of loan of Rs.5.00 lakhs on 15.05.2000, as alleged by the bank. He further submits that he is getting a salary of Rs.15,412/- and the salary of the petitioner cannot be attached.

When the petitioner did not challenge the award passed by the arbitrator on 30.08.2012, he cannot challenge the consequential proceedings issued by the second respondent dated 15.04.2015. In the circumstances, this Court finds no reason to entertain the present Writ Petition, and the same is, accordingly, dismissed at the admission stage.
