THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.6734 of 2018 ORDER:
This petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.196 of 2018 of Penamaluru Police Station, Vijayawada, Krishna District, registered for the offence punishable under Section 498-A, against the petitioners 2 to 4 and 6, who are relatives of the de facto complainant.
Whether these petitioners are actually involved in the above crime or not is to be decided by the committee constituted in view of the guidelines formulated by the Apex Court in Rajesh Sharma v. State of U.P.1 and the committee will consider the contention of the petitioners in the enquiry that the petitioners are involved directly or indirectly in the above crime. Therefore, at this stage, it is not proper to exercise jurisdiction under Section 482 Cr.P.C. since the committee has to decide the complicity of each of the petitioners on preliminary enquiry.
Therefore, without touching the merits, I find that it is a fit case to issue direction to the police to follow the guidelines issued by the Apex Court in "Rajesh Sharma v. State of U.P." (referred supra). Accordingly, police concerned are directed to adhere to the guidelines issued in "Rajesh Sharma v. State of U.P." (referred supra).
With the above direction, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
