This Criminal Petition is filed under section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for granting of prearrest bail to the petitioner/accused No.2 in Crime No.294 of 2025 of Mulugu Police Station, Mulugu District. 2.
The case of the prosecution is that the de-facto complainant lodged a report before the police on 17.07.2025, stating that accused Nos.1 to 7 were aware that an electrical wire, connected to the boundary wall of Md. Ghouse Pasha's house adjacent to the newly constructed site of accused No.3, was live and dangerous. Having knowledge of the same, the deceased, Chinthala Ravi, who was working on wire works, came into contact with the electrical wire and died on the spot. Hence, a case was registered vide Crime No.294 of 2025 before the Mulugu Police, for the offences punishable under Section 105 of the BNS.

Additional Public Prosecutor for respondent State. Perused the material available on record.

Learned counsel for the petitioner submits that the police registered a case against accused Nos.1 to 7 but later deleted the names of accused Nos.3 to 7. Accused No.1 is the husband of the petitioner, and the petitioner is not aware of the fact that the fencing wire was electrical. He further submitted that the petitioner is innocent. He also submitted that accused No.1 is released on bail and the entire investigation is completed. Hence, he seeks to allow the Criminal Petition. 5.
On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner and prayed this Court to dismiss the Criminal Petition.

Having regard to the rival submissions made by both parties and upon perusal of the material placed on record, it is noted that fourteen witnesses have been examined and the charge sheet has been filed. Considering the submissions of both sides and the material on record, since the petitioner is the wife of accused No.1 and there is no specific allegation against her and as accused No.1 is already released on bail, the petitioner is granted pre-arrest bail, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Mulugu Police Station, within two weeks from today, and on such surrender, the said Station House Officer shall release her on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., and thereafter, as and when required.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
