W.P.No.22059/2018 THE HON'BLE SRI JUSTI CE V. RAMASUBRAMANI AN THE HON'BLE MS. JUSTI CE J. UMA DEVI WRI T PETI TI ON No.22059 of 2018 ORDER: (Per VRS,J.) This writ petition, by the one of the guarantors, challenges an auction sale notice dated 08.06.2018, proposing to hold the auction on 28.06.2018.

2. It is represented by Mr. A. Krishnam Raju, learned Standing Counsel for the Bank that the auction did not take place on 28.06.2018 and it was cancelled. Thereafter, a fresh notice of sale was issued on 10.08.2018 and a sale in fact took place on 31.08.2018 and the buyer has also paid 25% of the sale consideration. So far the fresh auction sale notice dated 10.08.2018 or the auction held on 31.08.2018 has not come under challenge before this Court or the Debts Recovery Tribunal. Therefore, noting survives for adjudication in this writ petition. Hence it is dismissed. There will be no order as to costs.

3. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
