This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused seeking bail in the event of his arrest in connection with Crime No.2129 of 2021 on the file of APTS RR South, registered for the offence under Section 135(1)(a) of Electricity Act, 2003. 2.

The case of prosecution is that at the time of inspection, the petitioner-accused is utilizing supply by direct tapping from the nearby LT over headline by the means of PVC insulated cable and availing supply to run RO water plant, and total connected load is found to be 3457 W. Thus, petitioner has indulged in theft of electricity estimating at Rs.10,701/-.

Learned counsel for petitioner Sri Venkatesh Gupta submits that the petitioner has been implicated in this case falsely and he is unconnected with the alleged offence. He submits that the petitioner has paid an amount of Rs.10,701/- on 04.12.2021 and he also filed a memo showing receipt of payment.

Taking into consideration the fact that the petitioner has paid the demanded amount of Rs.10,701/- vide receipt dated 04.12.2021, this Court deems it appropriate to grant pre-arrest bail to petitioner. 5.

The Criminal Petition is allowed. Petitioner - Accused shall surrender before the Station House Officer, APTS, RR South, Police Station, Rajendranagar, in connection with Crime No.2129 of 2021 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he

shall be released on bail. It is made clear that no further extension of time will be granted.
