O R D E R

The grievance of the petitioner primary school is that the District Educational Officer, Chittoor, the third respondent, did not grant renewal of recognition for Classes 1 to 5 from the academic year 2008-09 to 201718. It is stated that the Mandal Educational Officer, Tirupati (Urban Mandal), under letter dated 22.01.2009 addressed to the District Educational Officer, Chittoor, forwarded the proposals submitted by the Correspondent of the petitioner primary school for renewal of recognition for Classes 1 to 5 for the academic year 2008-09 to 2017-18 and recommended approval of the same. However, the third respondent is yet to take action in the matter.

Sri P.Gangarami Reddy, learned counsel for the petitioner primary school, states that the high school run by the same management which runs the petitioner primary school has been granted recognition up to the academic year 2017-18, but the primary school is not being extended the same benefit.

As the recommendations of the Mandal Educational Officer, Tirupati Urban, date back to the year 2009, it is not open to the third respondent to keep the matter pending indefinitely. The writ petition is accordingly disposed of directing the District Educational Officer, Chittoor, the third respondent, to act upon the recommendations made by the Mandal Educational Officer, Tirupati Urban, under his letter dated 22.01.2009 and take appropriate action in the matter. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this Court. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
