This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri. SANKALP PISSAY, Advocate for the Petitioner and the Sri. Jithender Rao Veeramalla Additional Public Prosecutor on behalf of the Respondent. The Court made the following ORDER:
THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION No.10334 ot 2025 ORDER:- 1.
This Criminal Petition is filed by the petitioner/accused No.7 seeking to quash the proceedings in C.C.No.'|618 of 2024, on lhe file of the learned Xlll Metropolitan Magistrate, Kukatpally, Medchal District, registered for the offence punishable under Section 160 lPC.
2. Heard Sri Sankalp Pissay, learned counsel for the petitioner/accused No.7 as well as Sri Jitender Rao Veeramala, the learned Additional Public Prosecutor representing the respondentState. 3.
Learned counsel for the petitioner submits that the petitioner is innocent and that no such incident occurred as alleged by the prosecution and that the petitioner never quarreled with anyone and have not caused any obstruction to public peace and therefore requested to quash the proceedings against him. 4.
On the other hand, the learned Additional Public Prosecutor submitted that during the course of investigation, the Police have examined the eye witness as LW3 and thus, the matter needs to be decided during the course of trial 5.
Perused the record. The record discloses that the accused in C.C.No.1618 of 2024 are 41 to A12 and the allegations point out th?!_ _
41 to A7 formed into one group and AB to A12 into another group and a quarrel ensued between both the groups when the Ganesh I procession was going on. Truth or otherwise of the allegations shall be made out during the course of trial.

Hence, the Criminal Petition is disposed of directing the Trial Court to dispose of the matter at the earliest' However, the attendance of the petitioner/accused No.7 before the Trial Court is dispensed with provided that the petitioner is represented through an Advocate on every date of hearing and that he shall appear before the Trial Court as and when he is required during the course of trial ' Miscellaneous petitions pending, if any, shall stand closed' SDl-T.SRINIVASA REDDY ANT REGISTRAR //TRUE COPY// SECTION OFFICER To,
