HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.12472 of 2015 O R D E R :

The petitioner, who is accused in Crime No.462 of 2015 of Kancharapalem Police Station, Visakhapatnam City, registered for the offences punishable under Sections 307, 323, 506 read with Section 34 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The earlier bail petition Crl.P.No.11091 of 2015 filed by the petitioner was dismissed by this Court on 06-11-2015. There is no substantial change of circumstances. Even though it is stated by the learned counsel for the petitioner that the injured was discharged, the learned Public Prosecutor submitted that still he is in critical condition for which he is admitted in another Hospital. Considering the said facts and circumstances and also as the petitioner has some previous cases, this Court is not inclined to grant anticipatory bail to the petitioner - accused.
