ORDER
Heard learned counsel appearing for the petitioner and learned Government Pleader for Panchayatraj appearing for respondent No.1 and learned Standing Counsel appearing for respondent Nos.2 to 4.
This writ petition is filed seeking to declare the impugned proceedings dated 18.08.2015 issued by the 3rd respondent in terminating the petitioner from service, as arbitrary and illegal. The petitioner was appointed as computer Operator in 2008. While so, on the allegation of mis-appropriation of funds, he was kept under suspension vide proceedings dated 18.08.2015. Learned counsel appearing for the petitioner submits that the petitioner is only a Computer Operator, he has nothing to do with the financial matters, he was unnecessarily kept under suspension and that steps are being taken to launch criminal prosecution along with other employees.
On the other hand, learned Standing Counsel appearing for the respondents would submit that the order impugned is an order pending enquiry and criminal prosecution and therefore, it needs no interference.
Having regard to the submissions made by the learned counsel on either side, the Writ Petition is disposed of directing the 3rd respondent-Project Director to complete the enquiry and pass final order in accordance with law within a period of eight weeks from the date of receipt of a copy of this order, failing which the order impugned shall stand revoked. There shall be
no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
