HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.25453 of 2019 ORDER :

This writ petition is filed seeking Mandamus to declare the action of respondent No.2 in issuing Letter No.G1/Misc/2019, dt.01.06.2019 directing respondent No.3 to postpone the date for conducting the survey of the subject land of the petitioner in Sy.Nos.512, 561, 562, 637, 1026 and 1029, admeasuring Ac.0.1 gts, Ac.0.09 gts, Ac.0.01 gts, Ac.0.01 gts, Ac.0.06 gts. and Ac.0.04 gts, respectively, situated at Sadasivpet Village and Mandal, Sangareddy District, as arbitrary and illegal.

Heard Sri T.C.K. Singh, learned counsel for the petitioner and the learned Standing Counsel for respondent No.2 - Municipality.

Learned counsel for the petitioner submits that though the District Collector, Sangareddy District, ordered for survey of the subject land of the petitioner, respondent No.2 issued the impugned letter dt.01.06.2019 directing respondent No.3 to postpone conducting of the said survey, which is arbitrary and illegal.

In view of the same, there is no reason for respondent No.2 to direct respondent No.3 to postpone conducting of survey of the subject land.

ARR,J W.P.No.25453 of 2019 Accordingly, this writ petition is allowed setting aside the impugned order dt.01.06.2019 issued by respondent No.2 and respondent No.3 is directed to conduct survey of the subject land of the petitioner in Sy.Nos.512, 561, 562, 637, 1026 and 1029, admeasuring Ac.0.1 gts, Ac.0.09 gts, Ac.0.01 gts, Ac.0.01 gts, Ac.0.06 gts and Ac.0.04 gts, respectively, situated at Sadasivpet Village and Mandal, Sangareddy District, as ordered by the District Collector, Sangareddy District. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
