HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.31622 of 2015 ORDER:

Heard Sri Y.Subba Rao, learned counsel appearing for the petitioner and Sri M.S.R. Chandra Murthy, learned Special Counsel for the 3rd respondent-MGNREGS.

The petitioner was appointed as Field Assistant in 2008 in the 3rd respondent-MGNREGS and posted a t Kotha Yellavaram Panchayat, Golugonda Mandal. While so, on the allegation of misappropriation of funds, he was kept under suspension v i d e impugned proceedings dated 18.08.2015.

Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the misappropriation of funds, he was unnecessarily kept under suspension and that steps are being taken to launch criminal prosecution against him.

On the other hand, learned Special Counsel appearing for the respondents would submit that the order impugned is an order pending enquiry and criminal prosecution and therefore, it needs no interference.

Since the order impugned is an order of suspension pending enquiry, I am not inclined to

examine the merits of the case.

Therefore, the Writ Petition is disposed of directing the 3rd respondent-Project Director to complete the enquiry and pass final order in accordance with law within a period of eight weeks from the date of receipt of a copy of this order, failing which the order impugned shall stand revoked. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
