THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9097 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 2 seeking bail in connection with Crime No. 79 of 2023 dated 18.06.2023 on the file of Chinna Chintha Kunta Police Station, Mahabubnagar District registered for the offences punishable under Sections 324, 323, 504 read with 34 of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioners/Accused Nos.1 and 2 and learned Additional Public Prosecutor for the respondent-State and perused the record.

A complaint was filed on 18.06.2023 alleging that the petitioner along with others assaulted the de facto complainant near his fields. He was beaten on the hands and other parts of the body. The de facto complainant went to the hospital and after taking treatment went to the police station and lodged complaint.

Learned counsel for the petitioners/Accused Nos.1 and 2 would submit that bald allegations is made this these petitioners and others have attacked them keeping in view the old disputes.

The victim was not hospitalized, however he has received injuries on account of earlier disputes, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioners/Accused Nos.1 and 2 are directed to surrender before the Station House Officer, Chinna Chintha Kunta Police Station, Mahabubnagar District on 29.09.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 and 2 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.1 and 2 shall appear before the concerned police on every Monday for a period of eight weeks.

3) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
