O R D E R

This writ petition is filed for a writ of mandamus declaring the action of the respondent-municipal corporation in issuing the impugned notice purported to be a show cause notice containing orders directing the petitioners to pay trade license fee and to obtain trade license in respect of cloth business to run in their respective shops in the limits of Municipal Corporation, as illegal and arbitrary.

Today, when the matter is taken up for hearing, the learned counsel for the petitioners as well as the Smt Pingali Lakshmi, learned Standing counsel for respondent municipal corporation submitted that the lis in the writ petition is squarely covered by order dated 22.12.2011 in W.P.No.5937 of 2008 and by order dated 12.04.2007 in W.P.No.26636 of 1998. For the reasons stated in the above said writ petitions, this writ petition is disposed of by setting aside the impugned order and keeping open to the Corporation to issue fresh demand notice if the license fee is not paid by the petitioners. However, it is made clear that the issue whether 'cloth' is included in the schedule or not, for issuance of license and for collection of license fee, is left open. If any fresh notices are issued, liberty is reserved to the petitioners to raise such question, if they so choose. There shall be no order as to costs.
