THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5501 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against her in Crime No.88 of 2016 on the file of Central Crime Station, Hyderabad District, registered for the offence punishable under Sections 120-B, 420, 467, 468 and 471 IPC.

Heard and perused the material available on record. It is alleged that A1 and A2 represented to the 2nd respondent that there was a plot admeasuring 716 sq. yards in Jubilee Hills Cooperative House building society limited and the owner of the said land was very close to them. In February, 2013, A1 and A2 brought A3 to the office of the 2nd respondent and introduced him as the owner of the land. After negotiations between the 2nd respondent and A1 to A3, the total sale consideration for the above plot was fixed at Rs.3,22,20,000/- and the entire amount was paid in the form of 38 cheques. After taking possession of the plot, L.Ws.2 to 4 started interfering with the peaceful possession of the 2nd respondent over the land in question. Subsequently, on enquiries the 2nd respondent came to know that A1 to A4 played fraud by creating documents. Learned Counsel for the petitioner submitted that the petitioner is innocent and she has only mediated the said transaction, for which, she has been implicated in the above crime.

Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner. However, the 1st respondentpolice are directed to complete the investigation and file a final report, if any, without arresting the petitioner. In the event of necessity, the 1st respondent-police are directed to issue a notice to the petitioner to

appear before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioner is directed to appear before the investigating agency and give an undertaking as to her future appearance as and when required for the purpose of investigation.
