HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22235 OF 2018 O R D E R :

This writ petition is filed challenging the action of the 3rd respondent in not investigating into the crime No.82/2017 dated 11.06.2017 registered under Section 379 of IPC. Heard learned counsel for the petitioner.

The 2nd respondent filed counter stating that after investigation the same was referred as 'undetectable'; that final report was also filed under Section 173 Cr.P.C. before the Additional Junior Civil Judge's Court, Repalle, as per the orders of the SDPO, Bapatla vide C.No.479/SDPO-BPL/Refer/2018, dated 31.07.2018;

and that petitioner was also served with referred notice. The same is disputed by the learned counsel for the petitioner. In view of the same, the 3rd respondent is directed to serve a notice to the petitioner regarding filing of final report before the concerned criminal court within a period of one week from date of receipt of a copy of this order. It is also open for the petitioner to avail alternate remedy as may be available to him under law. With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
