THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7252 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.6 in Crime No.245 of 2022 pending on the file of Sircilla Police Station, Rajanna Sircilla District registered for the offences under Sections 120-B, 143, 147, 302, 324 and 506 read with Section 149 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused No.6 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the de facto complainant who is the wife of the deceased stated in her complaint dated 25.06.2022 that one Gotte Kiran asked her husband to come to Sircilla to discuss an issue. When the deceased went there, said Gotte Kiran had taken him to Rythu Bazaar and after they reached the said place,
other accused persons had surrounded and beat her husband, for which reason the deceased died.

Learned counsel for the petitioner submits that the name of this petitioner is not mentioned in the complaint, subsequently on the basis of confession, the petitioner is arrayed as Accused No.6 in the remand report dated 28.06.2022. He further submits that the petitioner is in jail since 28.06.2022.

In the said circumstances, for the reason of the petitioner's name not being mentioned in the First Information Report, the petitioner can be the relief of regular bail. 6.
Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Prl.Judicial First class Magistrate at Siricilla, Rajanna-Siricilla District. ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and
01.00 PM for a period of eight (08) weeks and thereafter shall appear as and when required.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
