THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7242 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.259 of 2022 pending on the file of Station House Officer, Abdullapurmet Police Station, Rachakonda registered for the offence punishable under Section 20(b)(ii)(C) of NDPS Act. 2.

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The petitioner was arrested on 01.06.2022 by the Abdullapurmet Police for the reason of finding 30 kgs of ganja in a plastic bag which he was carrying on his bike. The police conducted search in accordance with the provisions under NDPS Act and the petitioner was remanded to judicial custody on the very same day.

On instructions learned Assistant Public Prosecutor submits that three witnesses were examined and that samples were drawn and sent to FSL for examination. He further submits that there are no criminal antecedents as far as this petitioner is concerned. 5.

Keeping in view the detention of the petitioner since 01.06.2022 and that there are no criminal antecedents against this petitioner, the prayer for regular bail can be considered on conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for a like sum to the satisfaction of XXIV Additional Metropolitan Magistrate, Cyberabad at Hayathnagar.

ii) After release on bail, the petitioner/Accused shall appear before the concerned Station House Officer on every Monday and Thursday between 10.00 A.M to 1.00 P.M, for a period of three (03) months or until filing of charge sheet, whichever is earlier.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
