HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21807 OF 2017 O R D E R :

The case of the petitioners is that they are the absolute owners and possessors of the land in Survey Nos.226B/2B(A), admeasuring Ac.1.15 cents, situated at Markapur Village and Mandal, Prakasam district having inherited the same from their ancestors. It is also stated that the said land is abutting R& B road in Markapur Town and recently the respondent authorities have proposed to lay CC road in the place of existing road. In the said process, the respondent authorities made markings to widen the existing road. As such, the petitioners, in order to ascertain their extents, got surveyed the land through survey officials who conducted survey and fixed the boundary stones. But, the respondent authorities highhandedly made markings in the petitioners' lands and proceeding further to lay CC road through petitioners' lands. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioners.

Learned Assistant Government Pleader for Roads and Buildings on instructions submits that the respondent authorities will follow due process of law, in case if they undertake any action against the petitioners' land.

In view of the above facts and circumstances, the respondents are directed not to lay road through petitioners' lands, without following due process of law. No order as to costs.

Accordingly the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
