Aggrieved by the order dated 22.09.2016 passed by the Tahsildar, Gara Mandal, Srikakulam District, rejecting the request of the petitioner for issuance of pattadar passbook and title deeds with regard to the land to an extent of Ac.0.32 cents in Survey No.168/14 of Kothuru Syrigam Village, Srikakulam District, on the ground that O.S.No.179 of 2016 is pending on the file of the Court of Principal Junior Civil Judge, Srikakulam, appeal is preferred by the petitioner on 20.10.2016 and it appears, the same is acknowledged by the appellate authority. Alleging inaction on the said appeal, this Writ Petition is filed.

Since the petitioner claims to have filed appeal and the same is received by the Revenue Divisional Officer, Srikakulam District, the Court is not inclined to entertain the Writ Petition and keep the same pending.

The Writ Petition is accordingly disposed of directing the appellate authority to consider the appeal preferred by the petitioner after putting on notice the respondents before the appellate authority and after affording due opportunity to all the parties and pass appropriate orders as expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that there is no expression of opinion on the merits of the case and the rights of the respective parties are preserved.

Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
