HON'BLE SRI JUSTICE P.KESHAVA RAO W.P.No.30505 of 2014 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in this Writ Petition is as under: "........to issue Writ of Mandamus declaring the action of the respondents in not taking action on the complaint dt.02-10-2014 filed by the petitioner as illegal, arbitrary and against the principles of natural justice and consequently direct the respondents to register a crime against all the accused and file charge sheet within a time frame of one month." 3.

Learned Government Pleader appearing for the respondent Nos.1 to 4 placed on record Written Instructions dt.17-10-2019 issued by the Inspector of Police, Gachibowli Police Station, Cyberabad.

From the perusal of the said Written Instructions, it is revealed that the respondent-police received complaint of the petitioner dt.02-10-2014 and the same was registered as Crime No.106/2014 for the offences under Section 3 (1) (x) of SC/ST (POA) Act, 1989 and 506 IPC against one Ramanaiah and 25 others. After registering the crime, notice under Section 91 Cr.P.C. has been issued to the petitioner on 09-12-2014 and 5 witnesses were examined and their statements were recorded.

It is also further mentioned that as per the evidence collected during the course of investigation, none of the witnesses supported the complainant/petitioner's version. On 25-05-2015, the Assistant Commissioner of Police sent the CD file to the Commissioner of Police, Cyberabad, to accord permission to refer the case as 'lack of evidence'. Accordingly, final report was filed on 23-07-2015 before the Court of XXV Metropolitan Magistrate, Cyberabad at Kukatpally.

Along with the Written Instructions, a copy of the Final Report is also enclosed. The same are made as part of the record. 7.

In view of the above said facts and circumstances, this Court is of the opinion that no further cause would survive in the present Writ Petition and is devoid of merits. 8.

Accordingly, the Writ Petition is closed. No costs. 9.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
