HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.22667 of 2016 ORDER:

The petitioner's grievance is that he filed application on 16-11-2015 before the Revenue Divisional Officer (R.D.O.) to refer the same to Tahsildar for taking necessary action. As no action has been taken on the same, the present writ petition is filed. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader submits that neither the R.D.O. nor Tahsildar has power to cancel the pattadar passbooks and the petitioner has remedy under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short "the Act") to approach District Collector.

Learned counsel for the petitioner has not disputed the said submission.

In view of the same, I do not see any merit in the writ petition. Accordingly, the writ petition is dismissed giving liberty to the petitioner to approach the District Collector under Section 9 of the Act. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
