Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner states that he is the Managing Director of a Hospital, situated in Mamillagudem, Khammam, Khammam district. The Hospital is being run after obtaining certificate of registration on 13.08.2012. While so, the fourth respondent appears to have conducted inspection on 20.04.2017 and noticing certain irregularities cancelled the certificate of registration and gave 24 hours time for shifting the existing patients. Since no show cause notice was issued to the petitioner before taking the action of cancellation of registration, this Court is constrained to set aside the impugned cancellation order styled as notice dated 20.04.2017 and remands the matter to the fourth respondent for following due process of law before taking further action under the provisions of the Telangana State Allopathic Private Medical Care Establishments (Registration and Regulation) Act, 2002 and the Rules made thereunder.
The Writ Petition is, accordingly, allowed at the admission stage. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
