HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22149 OF 2018 ORDER :

This writ petition is filed challenging the action of the respondents in not allowing the petitioner to carry on the business of selling the cloths by opening the shop.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home appearing for respondents 1 to 4, basing on written instructions, submits that at the instance of the petitioner, a case in Cr.No.142/2018 was registered against the unofficial respondents on 20.06.2018 and at the instance of the 6th respondent, a case in Cr.No.144/2018 was registered against the petitioner on 21.06.2018 and the allegation that the petitioner is not being allowed to do business is being denied by the respondents and that the respondents never interfered with business of the petitioner and denied the other allegations made by the petitioner. Learned counsel for the petitioner submits that the petitioner made fresh complaint on 06.07.2018, but no action is being taken till date.

It is to be seen that petitioner filed suit against the unofficial respondents i.e., OS No.102 of 2018 wherein interim injunction was granted on 12.06.2018 in I.A.No.440 of 2018 in OS No.102 of 2018. Admittedly, civil dispute is pending between the petitioner and the 5th respondent. Even according to the petitioner, the officers, who were working as Circle Inspector and

Sub-Inspector who were arrayed as respondents, were also transferred and basing on written instructions produced by the learned Assistant Government Pleader for Home, the respondentpolice are not interfering with the business of the petitioner. Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of. However, if any complaint is made by the petitioner, the concerned SHO shall take action in accordance with law. It goes without saying that the respondent police shall not interfere with the civil disputes between the petitioner and the unofficial respondents. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 11.07.2018 kvs
