HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.9874 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to direct the 3rd respondent to restore water connection consumer CAN No.033118862, in respect of H.No.12-2-506/ 45, situated at Gudimalkapoor, Mehdipatnam, Hyderabad, which was disconnected without following the due process of law, or to direct the 3rd respondent to provide new water connection to the above house, in which the petitioner is residing.

The case of the petitioner is as follows:

The mother of the petitioner purchased the subject house and she took water connection to the above house. She died on 30.08.1995 and thereafter, on the application made by the father of the petitioner, the water connection was transferred in the name of his father. Subsequently, the father of the petitioner got second marriage. Thereafter, civil disputes arose between the petitioner and his father with regard to the subject house. The petitioner and his brother are residing in the subject house. The father of the petitioner is residing elsewhere along with his second wife. Due to the disputes with regard to the subject house, the father of the petitioner made an application to the 3rd respondent to disconnect the water connection to the subject house. On such application, the 3rd respondent disconnected the water connection. The petitioner made a representation requesting the 3rd respondent to restore the connection of water. But no action was taken so far. Hence, the petitioner filed this writ petition. Heard and perused the material available on record.

Considering the facts and circumstances of the case and the grievance of the petitioner, this Court is inclined to pass the following order:

The petitioner is directed to make an application to the 3rd respondent to provide water connection to the subject house and pay necessary fee. On such application being filed, the 3rd respondent is directed to provide water connection to the subject house, without insisting the petitioner to produce any document with regard to the title of the subject house."

With the above direction, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
