THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA APPEAL SUIT No.1651 of 1998 JUDGMENT:

The present appeal is preferred assailing the final decree passed in I.A.No.639 of 1986 in O.S.No.44 of 1973, dated 24-02-1998. The total value of the properties, which are shown in the schedule annexed to the decree shows Rs.23,005/-, out of which, the petitioners in final decree found entitled to Rs.11,502-75/- and the respondent an equal amount, who is admittedly the present appellant. When he preferred the present appeal, it is the duty of the appellant, to engage other counsel, when the counsel already on record, is no more. The address of the appellant shown as Occ: Computer office of the Joint Director (A.H), Warangal R/o.Waddenpally, Hanmkonda, Warangal.

Pursuant to the directions given by this Court, dated 23-022017, notice was sent to the appellant. Registry endorsed that notice sent to the appellant returned unserved for want of house number. 3.

Learned counsel for the respondent is present. 4.

The present lis is earlier notified and again re-notified today. The appeal relates to the year 1998, therefore, the present appeal is dismissed for non-prosecution. No costs.

As a sequel, miscellaneous petitions, if any, pending in this appeal, shall stand dismissed.
