THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.27121 OF 2007 ORDER:
On 27.3.2018 when the matter was called for hearing, there was no representation on behalf of the petitioner and hence, the registry was directed to list the matter under the caption of "for dismissal". Today, when the matter was taken up at 10.30 a.m., there was no representation on behalf of the petitioner and hence, the matter was passed over so as to enable the learned Counsel for the petitioner to argue the matter and again at 2.30 p.m., when the matter is taken up, there is no representation on behalf of the petitioner.
The learned Counsel for respondent No.3 appeared and submitted that the petitioner had availed loan by mortgaging the property and at the time of granting loan, respondent No.3 directed the petitioner to pay Rs.50,000/- towards the stamp duty and questioning the same, the present writ petition has been filed, and subsequently, the loan amount was disbursed to the petitioner and the petitioner also repaid the loan amount to the 3rd respondent-bank and in view of the same, nothing survives for adjudication in this writ petition.
Recording the above submission, the Writ Petition is dismissed as infructuous. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
