HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.1626 of 2018 ORDER:

Heard the counsel for the petitioner as well as the learned Public Prosecutor appearing for the respondent State. The present revision case is filed questioning the orders passed in Crl.M.P.No.2573 of 2018 in C.C.No.245 of 2018 dated 25.06.2018 on the file of the III Additional Chief Metropolitan Magistrate, Hyderabad, to the extent of directing the petitioner to furnish bank guarantee for an amount of Rs.10,00,000/- for the purpose of his visit to Dubai, Colombo and other countries from 02.07.2018 to 31.08.2018. The facts of the case are that the petitioner has been charged for the offence under Section 420 IPC. Pending the C.C., the petitioner filed a petition vide Crl.M.P.No.2573 of 2018 under Section 452 Cr.P.C. requesting to release his passport to enable him to visit foreign countries for the purpose of business transactions.

The Court below, after considering the facts mentioned in the petition, was pleased to allow the petition permitting the petitioner to visit Dubai, Colombo, Singapore, Thailand, Vietnam, Mauritius, Poland and Germany for the purpose of business transactions. However, the petitioner is directed to furnish bank guarantee for an amount of Rs.10,00,000/- before the Court below and on his return from the foreign trip, he is directed to re-deposit the passport before it on 05.09.2018.

orders, more particularly, to the extent of directing him to furnish bank guarantee for an amount of Rs.10,00,000/-, the present revision case is filed.

Learned counsel appearing for the petitioner would contend that imposition of condition to furnish bank guarantee for an amount of Rs.10,00,000/- is a onerous condition and the petitioner cannot comply with the same. Learned Public Prosecutor has not opposed the petition, but, requested this Court to impose a reasonable amount for furnishing bank guarantee.

Taking into consideration the said statement and having regard to the facts of the case, the criminal revision case is disposed of modifying the orders passed in Crl.M.P.No.2573 of 2018 to the extent of furnishing bank guarantee by reducing the same from Rs.10,00,000/- to Rs.5,00,000/- (Rupees Five lakhs only). The other conditions imposed by the Court below shall have to be complied with by the petitioner, more particularly, the re-deposit of the passport before the Court below on 05.09.2018.

Miscellaneous petitions, if any, shall also stand disposed of.
