THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.10257 OF 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for granting of pre-arrest bail to the petitioner/accused No.5 in Crime No.132 of 2025 of Dandepalli Police Station, Mancherial District. 2.

The case of the prosecution is that a complaint was lodged against the petitioner/accused No.5, stating that the marriage of the deceased was performed with accused No.1 on 10.02.2022. After the marriage, accused No.1 went abroad, and the deceased resided with accused Nos.2 to 5. It is stated that the deceased committed suicide on 06.07.2025 due to intolerable harassment by accused Nos.2 to 5. Hence, a case was registered vide Crime No.132 of 2025 before the Dandepalli Police, for the offences punishable under Sections 85 and 108 read with 3(5) of the BNS.

Heard Sri K.V.Subba Reddy, learned counsel appearing on behalf of the petitioner and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for respondent State. Perused the material available on record.

Learned counsel for the petitioner submits that the petitioner/accused No.5 residing separately at Karimngar and he is no way concerned in respect of the suicide committed by the deceased. He further submitted that the petitioner is innocent and he is no way concerned with the alleged offence. He also submitted that though there is no corroborative evidence to prove the alleged offences, he was implicated in the case with false and fabricated allegations. Hence, he prayed the Court to allow the Criminal Petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner are serious in nature and prayed to dismiss the Criminal Petition.

Having regard to the rival submissions made by both the parties and a perusal of the material placed on record, it appears that there are omnibus allegations against the petitioner under Sections 85 and 108 of the BNS, however, there is no specific allegation against the petitioner/accused No.5. In these circumstances the petitioner is granted pre-arrest bail, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Dandepalli Police Station, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., and thereafter, as and when required.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
