Learned counsel for the petitioner submitted that the petitioner may be permitted to withdraw the criminal petition with a liberty to file application under Section 205 Cr.P.C. or Rule 37 of the Criminal Rules of Practice before the Court below to dispense with the appearance of the petitioners. Recording the said submission, the criminal petition is dismissed as withdrawn with a liberty to file application under Section 205 Cr.P.C. or under Rule 37 of the Criminal Rules of Practice before the Court below and on filing such application after serving notice on the other side, the Court below is directed to dispose of the said application within a week from the date of filing the petition in accordance with law. Pending miscellaneous petitions in the petition, if any, shall stand closed.
