THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9114 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.1 seeking bail in connection with Crime No. 752 of 2023 dated 27.08.2023 on the file of Banjara Hills Police Station, Hyderabad District registered for the offences punishable under Sections 370, 370(A)(2) of Indian Penal Code (for short 'IPC') and Sections 3, 4 and 5 of PIT Act.

Heard learned counsel for the petitioner/Accused No.1 and learned Additional Public Prosecutor for the respondent-State and perused the record.

On 27.08.2023 the Banjara Hills Police went to "Heaven Family SPA", Road No. 12 and apprehended accused No.2 who was organizer of the Spa. Police found that prostitution was being run in the said premises under the garb of Spa. Police registered the case and also found that there were female members in the Spa

who were part of the prostitution being run by the accused No.2. During the course of investigation, it was known that this petitioner was the person who was the owner and responsible for running the said Spa. 4.

On instructions the learned Additional Public Prosecutor would submit that there are no other cases pending against the petitioner, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioner/Accused is directed to surrender before the Station House Officer, Banjara Hills Police Station, Hyderabad District on 29.09.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused shall appear before the concerned police everyday 10:00 A.M., and thereafter, as and when required for the purpose of investigation.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
