HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.292 of 2016 ORDER:

This petition is filed to withdraw O.P.No.1682 of 2014 from the file of I Additional Judge, Family Court, Ranga Reddy District at Malkajgiri, and transfer the same to Family Court, Secunderabad.

2. Wife filed this petition. According to her affidavit, she filed M.C.No.10 of 2015 for maintenance before Family Court, Secunderabad and the same is pending and she was granted only interim maintenance of Rs.10,000/-. She further stated that she filed O.P.No.709 of 2014 for restitution of conjugal rights before Family Court, Secunderabad, and the same is also pending. She further stated respondent-husband filed O.P.No.879 of 2015 for custody of minor son and it is also pending before Family Court, Secunderabad, therefore, to avoid conflicting decisions, she prayed for transfer of O.P.No.1682 of from Malkajgiri Court to Secunderabad.

3. Respondent has not filed any counter.

4. Heard both sides.

5. Advocate for respondent submitted that he has no objection for transfer, but the Secunderabad Court may be directed to dispose of the case within a stipulated time.

6. Considering the submissions of both sides, O.P.No.1682 of 2014 is withdraw from I Additional Family

Court, Ranga Reddy District at Malkajgiri, and transferred to Family Court, Secunderabad, to be tried along with other cases pending before it i.e., M.C.No.10 of 2015, O.P.No.709 of 2014 and O.P.No.879 of 2015. Family Court, Secunderabad, shall dispose of all these cases as expeditiously as possible, preferably within a period of six months from the date of receipt of the records from the Malajgiri Court.

7. Accordingly, this transfer C.M.P. is ordered.

8. Miscellaneous petitions pending, if any, shall stand closed.
