HON'BLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.309 OF 2000 JUDGMENT:

Today also, there is no representation for the appellants, despite listing the matter under the caption 'for dismissal'. As seen from the proceeding sheet, the instant appeal was dismissed for default on 06-07-2004, but it was restored later, by order, dated 28-09-2004, in C.M.P. No.11823 of 2004. Since no representation for the appellants, the second appeal is dismissed for non-prosecution. No order as to costs. As a sequel thereto, miscellaneous applications, if any, pending in the appeal, stand disposed of.
