This writ petition is filed challenging the action of respondent Nos.3 and 4 in seizing the Ashok Leyland Dost Vehicle belonging to the petitioner bearing Registration No.AP 29W 1285 pursuant to the panchanama dt.19.10.2019.

Learned Counsel for petitioner submits that in similar circumstances this Court passed interim order dt.22.05.2019 in IA.No.1 of 2019 in WP.No.10496 of 2019.

The same is not disputed by learned Assistant Government Pleader for Civil Supplies. Basing on written instructions he submits that on receipt of credible information the Civil Supplies and Police Department has caught the subject vehicle which was carrying (80) bags of PDS rice and the same was seized and the vehicle was handed over to the SHO, Chandampet for safe custody until further orders; that the seized PDS rice was handed over to the nearest rice mill M/s.Mahalaxmi Rice Mill, Kondamallepalli, for safe custody; that a report under Section 6-A of the Essential Commodities Act, 1955, has been submitted to the Collector (CS), Nalgonda; and that 6-A enquiry is pending before the Collector (CS), Nalgonda.

In view of the interim order passed in IA.No.1 of 2019 in WP.No.10496 of 2019, and since it is stated that the seized goods were handed over to the nearest rice miller for safe custody, there shall be a

direction to the respondents to release the vehicle of the petitioner bearing Registration No.AP 29W 1285 on condition of the petitioner furnishing personal bond and further an undertaking to be present before the authorities concerned as and when required. It is also made clear that if the petitioner do not present himself before the authorities concerned as and when required, the respondents shall be at liberty to initiate criminal proceedings against the petitioner and take appropriate action in accordance with law. This order will continue to be in force till conclusion of enquiry under Section 6-A of the Essential Commodities Act and further the 2nd respondent is directed to conclude the 6-A enquiry as expeditiously as possible.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
