THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.23908 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, order or direction more particularly in the nature of WRIT OF MANDAMUS declaring the inaction on the part of Respondents on the complaints/representations dt.17.07.2015; 30.11.2015;

08.05.2017;

11.05.2017 and 22.05.2017 submitted by the President, Mandal Praja Parisand to transfer 6th Respondent and to take action against him for the irregularities committed by him reported therein as illegal, irregular, irrational, amounts to non-discharge of legal obligations conferred on them under the provisions of Andhra Pradesh Panchayat Raj Act, 1994 and rules framed there under and offends Article of Constitution of India and consequently direct the respondents to take action against 6th Respondent for the irregularities committed by him and effect the order of transfer dt.14.08.2015 issued by 4th Respondent, transferring 6th Respondent immediately."

Heard learned counsel for the petitioner and learned Government Pleader for Panchayat Raj, representing the 1st respondent and learned Government Pleader for Revenue, representing for the respondents 2 and 3, Sri G.Seshadri, learned standing counsel, representing on behalf of

respondents 4 and 5, offers to file vakalat from oral instructions.

It is the submission that if not on the request of the petitioner, as part of administrative exigency, the 6th respondent was already transferred and enquiry is in process.

Having regard to the above, this writ petition is disposed of, with a direction to the respondents to consider and dispose of anything remained within the representation of the petitioner, last one dated 22.05.2017, within six weeks from the date of receipt of a copy of this order and communicate the result to the petitioner. Further grievance if any is left open.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
