THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9380 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.444 of 2023 on the file of Bachupally Police Station, Medchal-Malkajgiri District, registered for the offence under Section 20 (b) (ii) (C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that A-1 was found in possession of 1150 gms of Hash oil in small bottles. On the basis of confession of A-1, this petitioner was arrayed as A-3. During the course of investigation, A-1 had confessed that this petitioner was invested amount for

getting ganja and also hash oil which is seized in the present case.

Learned counsel appearing for the petitioner would submit that apart from confession, there is no other evidence to implicate this petitioner.

Learned Additional Public Prosecutor on instructions would submit that investigation is complete and charge sheet is already filed, however not numbered. 6.

Keeping in view that the basis for implication of this petitioner is confession and no seizures were effected, the prayer for regular bail can be accepted and accordingly, the petitioner be released on bail, subject to following conditions:

i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of PJCJ-Cum-XI Additional Metropolitan, Cyberabad, MedchalMalkajgiri District at Kukatpally.

ii) The petitioner/Accused No.3 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
