THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9162 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused seeking anticipatory bail in the event of his arrest in connection with Crime.No.240 of 2023 on the file of P.S.Narsampet Police Station, Warangal District, registered for the offence punishable under Section 307 of Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the de facto complainant is that this petitioner had attacked him on 02.07.2023 with stones at his house with an intention to kill him. He received injuries on his left hand fingers. He went to the local hospital, where he got first aid and thereafter he was admitted in Multi Speciality Hospital and undergone operation.

Learned counsel for the petitioner would submit that there is an unexplained delay of 15 days in lodging the

complaint. Further the injury received is on the fingers of the injured and it cannot be said that there any offence to attract an offence is under Section 307 of Indian Penal Code, utmost the offence under Section 324 of Indian Penal Code. 5.

Learned Public Prosecutor would submit that the petitioner was involved in six other cases.

Keeping in view that the injury was received on the fingers of the de facto complainant, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner, subject to the following conditions:

1) The petitioner/Accused is directed to surrender before the Station House Officer, Narsampet, on 03.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused shall appear before the concerned police everyday for a period of four weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
