Subhash Reddy) Learned counsel for the petitioner submitted that the subject matter of the present writ petition is squarely covered by the judgment of this Court in the case of K.C.P. Ltd. (Ramakrishna Cements) V. Commercial Tax Officer, Macherla, Guntur Dist in W.P.No.20920 of 1995, dated 18.10.2001. A copy of the said judgment is placed before this Court.

2) In view of the aforesaid judgment, the present writ petition is to be dismissed. The writ petition is accordingly dismissed. However, if there is any grievance against the Food Corporation of India, this order will not preclude the petitioner from approaching the appropriate authority, in which event, it is open to such authority to consider the grievance of petitioner on its own merits and pass appropriate orders.

3) As a sequel, miscellaneous petitions if any pending shall stand closed. No order as to costs.
