HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.8087 of 2010 ORDER:

This petition is filed under Section 482 Cr.P.C., to quash the proceedings against petitioners/A.1 & A.2 in CC No.96 of 2010 on the file of the Additional Judicial First Class Magistrate, Nizamabad.

2. Both the learned counsel in one voice submitted that the parties have settled the matter before the Lok Adalath on 08.08.2015 in connection with E.P.No.45 of 2012 in OS No.14 of 2009 on the file of the Principal District Judge, Nizamabad. Both the learned counsel further submitted that the parties have entered into compromise in this case also. Learned counsel placed reliance on the Lok Adalath award dated 08.08.2014. Relevant portion at para 3 of the Award reads as under:

"3. The judgment Debtor and his daughter namely Smt.G.Sabitha shall cause to cooperate in quashing the FIR No.124 of 2009 in CC No.66 of 2011 on the file of the Special Judicial First Class Magistrate, Mobile Court, Nizamabad, by filing memo or affidavit whatever is required before the Hon'ble High court in Criminal Petition No.8087 of 2010."

3. In the above para, C.C. number is mentioned as "66 of 2011" in stead of "96 of 2010". However, Crime number and Criminal Petition number are correctly mentioned.

4. Having regard to the facts and circumstances of the case, even if the criminal case is pending, no purpose will be served. In view of the settlement between the parties, the criminal petition is allowed, quashing the proceedings against petitioners/A.1 & A.2 in CC No.96 of 2010 on the file of the First Additional Judicial First Class Magistrate, Nizamabad. Miscellaneous petitions, pending if any, shall stand closed.
