HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.25355 OF 2019 ORDER (ORAL) :

This writ petition is filed by the petitioner seeking to declare the inaction of respondent Nos.2 to 4 in registering the petitioner's complaint dated 22.10.2019 against respondent No.5, who tried to encroach/grab his property bearing Plot No.67 admeasuring 200 square yards in survey Nos.274 and 275 of Shivapuri Colony, Keesara Village and Mandal, by destroying the boundary stones on 28.09.2019 and on 21.10.2019, as being illegal, arbitrary and unjust.

2. Heard Sri K. Buchi Babu, learned counsel for the petitioner, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4, and perused the material on record.

Learned Assistant Government Pleader for Home based on the written instructions dated 22.11.2019, a copy of which is placed before this Court, submits that pursuant to the complaint of the petitioner to respondent No.4 - Station House Officer, Keesara Police Station, Rachakonda Commissionerate, respondent No.4 has made an entry in the General Diary and enquired into. He further submits that on producing relevant documents by the petitioner in support of his case on 21.10.2019, a case in Crime No.596 of 2019 was registered by respondent No.4 for the offences punishable under Sections 447 and 427 of Indian Penal Code, 1860, on 21.11.2019.

In view of the aforesaid submissions of the learned Assistant Government Pleader for Home made on behalf of respondent No.4, since respondent No.4 has already registered a case based on the complaint of the petitioner, the grievance of the petitioner stands redressed and, therefore, this Court is of the view that no further orders are required to be passed in the matter.

5. Therefore, recording the submissions of the learned Assistant Government Pleader for Home, the writ petition is closed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
