This writ petition is filed under Article 226 of the Constitution of India to declare the action of the respondents 3 and 4 in repeatedly calling the petitioner to the police station and pressurizing the petitioner and other committee members of Masjid-A-Noor Ahale Sunnathe Mosque Society to follow the customs and practices as directed by the 5th respondent as illegal and arbitrary.
2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home and perused the record.
3. Learned Assistant Government Pleader for Home produced written instructions stating that the 5th respondent gave a complaint to 3rd respondent stating that he is a Mutavalli and the petitioner and others are interfering and collecting money by forming a committee in the name of Masjid-A-Noor Ahale Sunnathe. After receipt of the complaint, General Diary entry was made on 17.06.2018. Thereafter, the 3rd respondent called both parties to the police station and informed to approach either the Wakf Board or the concerned Court and also told them not to create any law and order problem.
4. Recording the same, the writ petition is disposed of. However, the respondents-police shall not interfere with liberty of petitioner, except in accordance with law. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
