Heard the learned counsel for the petitioners. 2.
The prayer sought in the Writ Petition is as under: "...to issue a writ, order or direction more particularly one in the nature of a writ of mandamus declaring the prescribing of a condition of successful candidate being within "top 20 percentile of successful candidates in Class XII examination conducted by the respective boards in respective categories" by the respondents 1 to 5 for admission into participating IITs as arbitrary, unreasonable, unjust, unfair, discriminatory, biased and in violation of the petitioners fundamental rights guaranteed by Articles 14 and 21 of the Constitution of India and to direct the Respondents to admit the petitioners into the courses offered by the IITs based on their preference and ranking in JEE (Advanced)- by setting aside seat cancellation letter dated 07.07.
2013 issued by the 4th Respondent or in the alternative to declare the action of the Respondents No.
14 & 21 of the Constitution of India and to direct the Respondents No.3 to 5 to admit the petitioners into the B.Tech Courses into the IITs based on their ranking in JEE (Advanced)-2013 by setting aside seat cancellation letter dated 07.07.2013 issued by the 4th Respondent." 3.
Learned counsel appearing for respondent No.2 would submit that in the light of the order sought in the Writ Petition, no further cause would survive in the present Writ Petition and hence, the Writ Petition has become infructuous. 4.
Taking into consideration the said submission, the Writ Petition is dismissed as infructuous.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
