THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20688 of 2008 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the impugned Memo No.CMD/ CGM(HRD)/ GM(S)/ ASDC/ PO / F.No.2664-D/ 08-1 dt.5.7.2008 issued by the 1st respondent as illegal and arbitrary and to set aside the same and consequently to grant all other consequential benefits.

When the matter is taken up for hearing, it is informed by the learned counsel for the petitioner that the petitioner was reinstated into service consequent upon his ac quittal in the criminal case vide proceedings dated 27.7.2018.

The petitioner is challenging the termination order dated 5.7.2008. In view of the subsequent development of reinstatement of the petitioner into service vide proceedings dated 27.7.2018, the cause in the writ petition does not survive. However, the petitioner can be directed to submit a representation to the respondents seeking regularization and other service benefits on par with the persons who were recruited along with him.

Accordingly, the Writ Petition is disposed of giving liberty to the petitioner to submit a representation to the respondents within two weeks from the date of receipt of a copy of this order and on receipt of such representation, the respondents shall consider and

pass appropriate orders, in accordance with rules within a period of four weeks thereafter. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ____________________________ ABHINAND KUMAR SHAVILI, J Date: 17/ 09/ 2018 lkv
