THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CIVIL REVISION PETITION No.2846 OF 2016 ORDER:

This revision, under Article 227 of the Constitution of India, is filed challenging the Order dated 27.04.2016 in I.A. No.246 of 2016 in O.S. No.603 of 2009 passed by the XIII Additional Chief Judge (FTC), City Civil Court, Hyderabad, whereby the petition filed under Clause (c) to Rule 1 of Order XVI read with Section 151 of the Code of Civil Procedure, 1908, to summon the District Registrar, Hyderabad to produce registers, was dismissed.

02. This revision is filed raising various contentions pointing out the illegalities committed by the trial court.

03. However, during hearing, Sri D.V. Reddy, learned counsel for the respondents, reported no objection to take summons to the District Registrar and to produce the Registers.

04. In view of the concession made by the learned counsel for the respondents, the revision petition is allowed. However, the revision petitioner is directed to pay process fee, within 7 (seven) days from the date of this order, before the trial court and take out summons through the Court, to examine him as a witness on behalf of the petitioner within one month from today. If the petitioner failed to take out summons as directed by this court the petition shall stand dismissed. No costs.

05. Miscellaneous petitions, if any, pending in this revision shall stand closed.
