THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL MISCELLANEOUS APPEAL No.554 of 2006 JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) This Civil Miscellaneous Appeal is filed aggrieved by the order and decree dated 16.02.2005 in O.P.No.26 of 2002 passed by the Principal Senior Civil Judge, Ranga Reddy District, whereby the petition filed by the appellanthusband against the respondent-wife, under Section 13 (1) (ia) of Hindu Marriage Act, for dissolution of their marriage, was dismissed.

When the matter is called for hearing, Sri Rama Chandra Gurram, learned counsel, submitted that in view of the subsequent order dated 30.10.2006 passed in FCOP.No.295 of 2006 on the file of the Judge, Family Court at Hyderabad, the subject matter of the appeal has become infructuous. A copy of the decree passed in the said FCOP is placed on record.

Recording the aforesaid submission, the Civil Miscelleneous Appeal is dismissed as infructuous. No order as to costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
