HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TR.C.M.P. No.301 of 2015 COMMON ORDER:

This petition is filed under Section 24 of CPC to withdraw O.P.No.1673 of 2014 from the file of the Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to the Additional Family Court, City Civil Court, Hyderabad.

2. Heard both counsel.

3. The learned counsel for both parties in one voice submitted that H.M.O.P.No.1538 of 2014 filed by the petitioner is pending on the file of the Additional Family Court, City Civil Court, Hyderabad and both parties have no objection for transfer of O.P.No.1673 of 2014 to the Court of Additional Family Court, City Civil Court, Hyderabad.

4. Learned counsel for the respondent submitted that the presence of the respondent may be dispensed with for each and every date of adjournment in O.P.No.1673 of 2014.

5. Having regard to the facts and circumstances of the case and also submissions made by both counsel, O.P.No.1673 of 2014 is withdrawn from the file of Family Court, Ranga Reddy District at L.B. Nagar and transferred to the Additional Family Court, City Civil Court, Hyderabad. The Additional Family Court, City Civil Court, Hyderabad is hereby directed to dispense with the presence of respondent/husband for each and every date of adjournment. However, respondent shall appear as and when the Court feels that his presence is so required.

6. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs. As a sequel, miscellaneous petitions, if any pending in this civil miscellaneous petition, shall stand closed.
