THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.9198, 9115 & 9117 of 2023 COMMON ORDER:

Criminal Petition 9198 of 2023 is filed by Accused No.13; Criminal Petition No.9115 of 2023 is filed by Accused No.22; Criminal Petition No.9117 of 2023 is filed by Accused No.18 seeking bail in the event of their arrest in connection with Crime No.120 of 2023 on the file of Gudimalkapur Police Station, Hyderabad, registered for the offence under Sections 8(c) r/w. 20 (b) (ii) (A), 22(c), 27, 27(A), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record. 3.

The Gudimalkapur Police arrested some of the accused for being found in possession of drugs. During the course of the investigation, it was found that there are several purchasers of the said drugs and were purchasing the said drugs for the purpose of consumption. These petitioners are identified as consumers.

The allegation against the petitioners is that they are consumers, this Court inclined to grant Anticipatory Bail to the petitioners in the event of their arrest, subject to the following conditions:

1) The petitioners/A13, A22 & A18, respectively, are directed to surrender before the Station House Officer, Gudimalkapur

Police Station, Hyderabad, on 26.09.2023.

On such surrender, the said Station House Officer shall release the petitioners/A13, A22 & A18 on bail, on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A22 shall appear before the concerned police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of four weeks and thereafter as and when required, petitioners/A13 & A18 shall appear before the concerned police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of eight weeks and thereafter as and when required, for the purpose of investigation.

3) The petitioners/A13, A22 & A18 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.
