THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20961 of 2016 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies (Andhra Pradesh). The petitioner is the fair price shop dealer of shop No. 36 of Mallavolu Village, Machavaram Mandal, Guntur District. On the allegation that there was variation in the stock to be distributed, a show cause notice was issued to the petitioner on 09.05.2016. He submitted the explanation on 18.05.2016. Not satisfied with the same, the 2nd respondent Revenue Divisional Officer, Gurazala suspended the authorization of the petitioner, pending inquiry, vide proceedings, dated 16.06.2016, which is questioned in this Writ Petition. In view of the serious nature of the charges framed against the petitioner, this Court is of the opinion that it is not a fit case to interfere with the impugned proceedings. However, since the petitioner has already responded to the show cause notice dated 09.05.2016, ends of justice would be met if the inquiry is directed to be completed within a stipulated period.

The 2nd respondent is therefore, directed to conduct the inquiry and pass appropriate final orders within a period of six weeks from the date of receipt of a copy of this order, taking into account and consideration the explanation of the petitioner and after providing him the personal hearing. If the inquiry is not completed, as aforesaid, the order of suspension dated 16.06.2016 shall automatically stand dissolved.

With this order, the Writ Petition stands disposed of. No costs. Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
