THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B.BHOSALE & THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3953 of 2004 ORDER: (Per Hon'ble the Acting Chief Justice Dilip B.Bhosale) Heard Mr. P. Venkataramana, learned counsel holding for Mr. V. Venkataramana, advocate on record for petitioner. None appears for respondents, though served.
2. The petitioner in the instant writ petition, seeks the following relief: "For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Honourable Court may be pleased to issue a writ of Mandamus or any other appropriate writ and direct the respondents to act in accordance with law and forbear from interfering with the possession and enjoyment of the petitioner over the land admeasuring AC. 9.44 cents in Sy.No.281/2 of Kondapalli Village, Ibrahimpatnam Mandal, Krishna District except in accordance with law and without putting the petitioner on notice and without affording an opportunity of hearing about any invalidity which can be attributed to the lands of the petitioner and grant such other relief as it deems fit in the circumstances of the case."
3. This Court, while admitting the writ petition on 05.03.2004, passed interim direction as prayed for in WPMP.No.5205 of 2004. The interim order operates till today. Having regard thereto and considering the prayer in the writ petition, we are satisfied that this writ petition can be conveniently disposed of by the following order. "If the respondents intend to take or interfere with the possession of the petitioner in respect of the subject property, they shall follow the due process of law."
The writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
